The Appeals Court reasoned that just because the lyrics in question are short and maybe even popular, and used in many song doesn't mean it should automatically be dismissed. Trademark is about how something is being used or will be used in the market in relation to the consumer. A tweet does not show ownership, nor does that mean it is “published” by copyright standards nor does it mean somebody else can’t trademark it
